Terms of Service
Effective: October 1, 2026 · Last updated: October 1, 2026
1. Who We Are and What These Terms Cover
Acworth Games, LLC ("Acworth Games," "we," "us," or "our") operates AcworthGames.com and publishes games, applications, websites, online features, and related products and services. Collectively, these are the "Services."
These Terms of Service ("Terms") govern your access to and use of the Services. By downloading, installing, accessing, purchasing, or using a Service, you agree to these Terms. If you do not agree, do not use the Services.
Certain Services or features may include supplemental terms, rules, notices, or disclosures. If supplemental terms conflict with these Terms, the supplemental terms control for that specific Service or feature to the extent of the conflict.
2. Privacy
Our handling of personal information is described in the Acworth Games Privacy Policy. The Privacy Policy is maintained separately so that our disclosures can remain accurate as our Services, providers, and legal obligations change.
3. License to Use the Services
Subject to these Terms, Acworth Games grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for personal, non-commercial entertainment purposes.
Except where expressly permitted by Acworth Games or applicable law, you may not:
- copy, distribute, sell, rent, lease, sublicense, or commercially exploit the Services;
- circumvent security, access controls, payment systems, or technical restrictions;
- use Acworth Games assets in a way that falsely suggests sponsorship, endorsement, or affiliation;
- access systems or data without authorization; or
- use the Services for unlawful purposes.
Nothing in these Terms restricts rights that applicable law expressly gives you, including rights relating to interoperability, fair use, or lawful reverse engineering where those rights cannot be waived.
4. Eligibility
You may use the Services only if you are legally permitted to do so where you live. If you are under the age at which you may independently agree to contracts in your jurisdiction, a parent or legal guardian may need to review and agree to these Terms on your behalf.
Some Services, features, purchases, advertising experiences, or online functionality may be limited based on age, region, device, platform requirements, or applicable law.
5. Platform Services
Acworth Games products may be distributed through third-party platforms such as Google Play or other application stores, storefronts, or digital distribution services.
Your use of those platforms may also be governed by their own terms, policies, account requirements, payment rules, and technical requirements. Where mandatory platform terms conflict with these Terms, the applicable platform requirements control to the extent required.
Third-party platform providers are responsible for their own services, systems, and policies.
6. Accounts and Online Features
Some Services may use platform accounts, online profiles, cloud saves, achievements, leaderboards, multiplayer services, or similar features.
Availability may depend on factors including:
- your device and operating system;
- your internet connection;
- your platform account;
- your geographic region;
- third-party service availability;
- age or eligibility requirements; and
- the version of the Service you are using.
We do not guarantee that every online or platform-dependent feature will always be available. You are responsible for maintaining the security of accounts and credentials under your control.
7. Purchases
Some Services may offer paid downloads, in-app purchases, downloadable content, subscriptions, virtual items, upgrades, or other digital products.
Purchases made through a third-party platform are processed by that platform and are subject to its billing, payment, cancellation, and refund policies. Prices, availability, taxes, billing methods, and currency may vary by platform or region.
Unless otherwise required by applicable law or platform policy, digital purchases may become final once delivered, consumed, or made available.
8. Virtual Items, Currency, and Progression
Some Services may include virtual currency, items, characters, abilities, upgrades, unlocks, progression, achievements, or other digital benefits.
Unless expressly stated otherwise:
- virtual items have no monetary value outside the applicable Service;
- virtual items are not legal tender;
- virtual items cannot be exchanged for real-world money;
- virtual items are licensed, not sold;
- virtual items may be limited to a particular account, device, platform, or Service; and
- game systems, progression, balance, prices, and virtual items may change over time.
We may modify these systems when reasonably necessary for balancing, development, technical changes, security, legal compliance, compatibility, or continued operation of a Service.
9. Advertising
Some Services may display advertising. Advertising may be provided by third-party advertising services. Depending on your location, consent choices, device settings, account settings, and applicable law, advertising may be personalized or non-personalized.
Our collection and use of information associated with advertising is described in our Privacy Policy. Third-party advertising providers may also maintain their own terms and privacy policies.
10. Acceptable Use
You may not use the Services in a way that:
- violates applicable law;
- compromises or attempts to compromise another person's account;
- interferes with the operation, availability, or security of a Service;
- introduces malicious software, scripts, or harmful code;
- abuses, attacks, overloads, or disrupts our infrastructure or third-party infrastructure;
- fraudulently obtains purchases, virtual items, benefits, or account access;
- circumvents payment systems or technical protections;
- impersonates Acworth Games or its representatives;
- uses exploits to disrupt the experience of other users; or
- infringes intellectual property or other legal rights.
We may investigate suspected abuse and take reasonable measures to protect the Services, users, systems, and third-party providers.
11. Cheating, Exploits, and Unauthorized Modification
Where a Service includes competitive, online, progression-based, or account-based functionality, you may not use unauthorized tools, exploits, modified clients, automation, cheats, or other methods intended to gain an unfair advantage, manipulate progression, interfere with other users, or compromise the integrity of the Service.
We may correct game state, remove improperly obtained benefits, restrict access to affected features, or take other reasonable corrective action.
Nothing in this section prohibits legitimate security research or activities that applicable law expressly protects.
12. Intellectual Property
Except for third-party materials identified separately, the Services and their original content are owned by or licensed to Acworth Games and are protected by copyright, trademark, and other intellectual property laws.
This may include software, game design, artwork, animation, user interfaces, characters, names, logos, visual effects, sound effects, music owned by Acworth Games, written content, and branding.
These Terms do not transfer ownership of Acworth Games intellectual property to you.
13. Third-Party Software and Content
Our Services may include third-party software, open-source components, libraries, fonts, music, artwork, platform integrations, or other licensed materials. Those materials may be governed by separate licenses.
Applicable attribution, copyright notices, open-source licenses, and third-party notices may be provided within the relevant Service, through a Credits or Legal interface, in accompanying files, or through a Service-specific page on the Acworth Games website.
Nothing in these Terms limits rights granted directly to you under an applicable third-party or open-source license.
14. Licensed Music and Media
Some Services may contain music, recordings, artwork, or other media licensed from third parties.
Your access to that content through a Service does not give you the right to separately extract, reproduce, redistribute, sell, publicly perform, synchronize, or commercially exploit that content unless permitted by the applicable rights holder or applicable law.
Where appropriate, Acworth Games may provide attribution, credits, or links to the applicable artists, creators, or services.
15. User Content
Some current or future Services may allow users to create, submit, upload, display, transmit, or share content. If a Service supports user content, additional rules may apply.
Unless supplemental terms state otherwise, you retain ownership of content you create, but you grant Acworth Games the limited rights reasonably necessary to host, transmit, display, process, moderate, or otherwise operate the applicable feature.
You are responsible for ensuring that content you submit does not violate applicable law or the rights of others. If a Service does not provide user-generated content features, this section does not create such a feature or require Acworth Games to provide one.
16. Updates and Changes to the Services
We may release updates, patches, balance changes, content additions, compatibility changes, security fixes, or other modifications. Some updates may be required to continue using a Service or particular features.
We may add, modify, replace, restrict, or remove features when reasonably necessary for continued development, game balancing, technical improvement, platform compatibility, security, legal compliance, service availability, or changes to third-party providers.
We do not guarantee that a particular feature, item, game mode, service, or integration will remain available indefinitely.
17. Availability
We aim to keep our Services functional and available, but we do not guarantee uninterrupted or error-free operation.
A Service or feature may become unavailable due to maintenance, software defects, security incidents, device incompatibility, connectivity issues, platform outages, changes by third-party providers, legal or regulatory requirements, discontinued technology, or circumstances outside our reasonable control.
18. Suspension and Termination
You may stop using a Service at any time.
We may restrict, suspend, or terminate access to some or all online or service-dependent functionality where reasonably necessary to protect the security or integrity of the Services, prevent fraud or abuse, comply with law or platform requirements, enforce these Terms, discontinue a Service or feature, or respond to significant technical or operational risks.
Where appropriate and reasonably possible, we may provide notice before terminating a major online Service, but we do not guarantee advance notice in emergencies or situations outside our control.
19. Feedback
If you voluntarily provide suggestions, ideas, bug reports, feature requests, or other feedback about the Services, you allow Acworth Games to use that feedback without restriction or compensation to you.
This does not transfer ownership of unrelated intellectual property or confidential information that you clearly identify and that we have separately agreed to receive in confidence.
20. Third-Party Services and Links
The Services may include links to or integrations with third-party websites, platforms, stores, advertising providers, music services, social platforms, or other services. Acworth Games does not control those third-party services.
Your use of a third-party service is governed by the applicable third party's terms and policies. We are not responsible for third-party content, availability, security, privacy practices, or services except where responsibility cannot legally be excluded.
21. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis.
Acworth Games does not guarantee that the Services will:
- always be available;
- operate without interruption;
- be error-free;
- be compatible with every device or operating system;
- preserve all game progress in every circumstance; or
- be free from defects or security vulnerabilities.
Nothing in these Terms excludes warranties, guarantees, consumer protections, or statutory rights that cannot legally be excluded.
22. Limitation of Liability
To the maximum extent permitted by applicable law, Acworth Games and its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of the Services.
This may include loss of data, game progress, business opportunities, revenue, or other intangible losses.
Where liability cannot legally be excluded, it will be limited only to the extent permitted by applicable law. Nothing in these Terms excludes or limits liability where doing so would be prohibited by law.
23. Consumer Rights
You may have legal rights under consumer protection laws that apply where you live. Nothing in these Terms is intended to waive, limit, or exclude rights that cannot legally be waived, limited, or excluded.
If a provision of these Terms conflicts with mandatory consumer protection law applicable to you, that law controls to the extent of the conflict.
24. Changes to These Terms
We may update these Terms to reflect changes to our Services, business practices, platform requirements, technology, legal requirements, third-party providers, or the way our products operate.
When we update these Terms, we will change the "Last updated" date at the top of this page. If a change materially affects your rights or obligations, we may provide additional notice where required by law.
Your continued use of the Services after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by applicable law.
25. Governing Law
These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-law principles, except where mandatory law requires otherwise.
Any dispute that may properly be brought in court will be subject to the jurisdiction of the applicable state or federal courts in Georgia, except where applicable law gives you the right to bring a claim elsewhere.
Nothing in this section limits mandatory rights available to consumers under the laws applicable where they live.
26. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the maximum extent permitted by law.
If possible, the invalid provision will be interpreted or limited in a way that most closely reflects its original purpose while remaining enforceable.
27. No Waiver
If Acworth Games does not immediately enforce a provision of these Terms, that does not waive our right to enforce it later. A waiver applies only if expressly provided and only to the specific matter covered by that waiver.
28. Entire Agreement
These Terms, together with the Acworth Games Privacy Policy, any applicable Service-specific supplemental terms, applicable purchase terms, and applicable third-party license terms constitute the agreement governing your use of the Services.
Third-party software and services remain subject to their respective terms and licenses.

30. Platform-Specific Terms
If you download or access a Service through a third-party platform, your use of that platform remains subject to its applicable terms and policies.
Platform providers are not responsible for the development, operation, maintenance, or support of Acworth Games Services except to the extent expressly provided by that platform under its own agreements, services, or policies.
